Privacy and Personal Data Notice

Under Turkish Law No. 6698 on the Protection of Personal Data (the “KVKK”), the data controller is:

Depending on how you use the website, the following personal data may be processed:

• your name and contact details (telephone number and, where necessary, email address);
• messages you choose to send through the contact forms;
• property preferences, budget range, purchase timeframe and selection information;
• if you submit a review: your name, city, review, rating, photo and the related record information;
• if you send a sale or long-term letting request through the “For owners” section: your name, phone number, WhatsApp number, email address and preferred way of contact; the property’s country, city, district, address and optional map position; its characteristics; the asking price or rent; the property photos you upload; your statement that you are the owner or an authorised representative; the record of your explicit consent; and internal notes on the review of the request;
• property information, links, preferences, doubts and notes you enter into the INEST LAB tools, and photos you upload to the image-generation tools;
• the questions you ask in the “Ask INEST” tool, and the earlier questions and answers of the same conversation (used only to prepare the answer and not stored by INEST HOMES);
• pages visited, the referring page, browser and device information, IP address, and technical records generated for the security of the website, the prevention of misuse and its technical operation;
• with your consent in the cookie settings, analytics data on the use of the website and, separately, advertising measurement data: whether a visit from a Google ad led to an enquiry (a WhatsApp click, a tap on the telephone number or a sent form), never the content of the enquiry.

Your personal data may be processed, within the provisions of the KVKK applicable to the processing activity concerned, for the following purposes:

• responding to your enquiries and property requests;
• contacting you and providing the property selection or advisory service you have requested;
• handling matters relating to the properties you have saved or asked about;
• reviewing and managing client reviews and publishing them where you have permitted this;
• reviewing owners’ sale or letting requests, contacting the applicant, checking the property, the ownership, the terms of intermediation and any permits required, and preparing a draft listing once the parties agree;
• running the INEST LAB decision-support and visual tools at your request, and answering your questions in the “Ask INEST” tool from the published catalogue and INEST’s own texts;
• ensuring the security of the website and preventing misuse and excessive use;
• measuring the use of the website and improving our services and, with your separate consent, measuring the effectiveness of our advertising;
• complying with legal obligations and establishing, exercising or protecting rights.

Personal data is collected electronically through the forms on the website, the INEST LAB tools you use, the technical connections made with the website, the communication channels you initiate, and the necessary technical and analytics systems.

Depending on the processing activity, personal data may be processed on the legal grounds set out in Article 5 of the KVKK, in particular where processing is directly related to the conclusion or performance of a contract, where it is necessary for the data controller to comply with a legal obligation, where it is necessary for the establishment, exercise or protection of a right, or where it is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Where explicit consent is required for a processing activity, it will be requested separately. This Notice is not an explicit consent form.

For owner requests, explicit consent is obtained through a separate checkbox in the request form. No title deeds, identity documents or similar documents are requested through the form; where they are needed, INEST HOMES requests them separately through a secure channel. Requests and photos are not published on the website and can be viewed only by authorised INEST HOMES staff.

In order to operate the website and provide the services you request, personal data may be processed by, or shared with, technical infrastructure and service providers to the extent necessary.

With the website’s current infrastructure, these may in particular include:

• Netlify, for hosting, forms, server functions, the database, file storage and technical infrastructure;
• Google (Google Analytics and Google Ads), for measuring the use of the website and, with your separate consent, the effectiveness of our advertising, each only to the extent allowed in the cookie settings; with advertising consent Google may also use this data in its own advertising services under its own terms;
• Anthropic (through Netlify AI Gateway), for the AI processing of the relevant text, questions and input, when you expressly start an INEST LAB analysis such as “Challenge my choice” or send a question in the “Ask INEST” tool;
• OpenAI, for processing the uploaded image and related instructions in order to generate an image, when you expressly use the “Try an interior” feature;
• WhatsApp, Telegram or other external services, where you yourself click the relevant link.

Only the data necessary to perform the service concerned is intended to be transferred to service providers.

Some of the technical infrastructure, analytics and artificial intelligence service providers used by INEST HOMES may provide their services through systems located outside Türkiye. Personal data may therefore be processed abroad, depending on the nature of the service concerned.

Where personal data needs to be transferred abroad, the transfer is carried out taking into account the conditions and appropriate safeguards set out in Article 9 of the KVKK and the applicable secondary legislation.

Personal data is retained for as long as necessary for the purpose for which it is processed, taking into account the obligations arising under applicable legislation. Once the purpose of processing and any applicable legal retention requirement have ended, the data is erased, destroyed or anonymised in accordance with applicable legislation.

Owner requests and their photos are retained for as long as necessary to review the request, carry out the intermediation relationship and meet applicable legal obligations. Photos uploaded to request forms that are never sent are deleted automatically shortly afterwards.

Certain preferences and INEST LAB states kept in the browser on your own device only may remain there until you clear them or the browser session concerned ends.

Under Article 11 of the KVKK, data subjects have the right to apply to the data controller in order to:

• learn whether personal data concerning them is processed;
• request information on the processing, if their data has been processed;
• learn the purpose of the processing and whether the data is used in line with that purpose;
• know the third parties in Türkiye or abroad to whom the data has been transferred;
• request the rectification of incomplete or inaccurately processed data;
• request the erasure or destruction of the data under the conditions set out in the legislation;
• request that the rectification, erasure or destruction be notified to the third parties to whom the data has been transferred;
• object to a result to their detriment arising from analysis carried out exclusively by automated systems;
• claim compensation for damage suffered as a result of the unlawful processing of personal data.

This Notice may be updated if the data processing activities on the website or the relevant legislation change. The current version is published on this page.
